he thought would detote that bomb and the federal agents at that point this morning swept in and arrested him. at the last minute, he also allegedly told the agent that he had a suicide backup plan, but that apparently did not work out either. prosecutors say in attempting to destroy the landmark federal reserve building, likely killed untold numbers of bystanders and that he quoted from the man that he called his beloved shake, osama bin laden, to justify the deaths of women and children. he is expected in coursoon. charged with attempted use of a weapon of mass destruction, as well as providing support to al- qaeda. he faces up to a maximum of life in prison and now comes word that he may also have been looking at attacking a military

base near baltimore and that he was hoping to affect the outcome of the presidential election. derek. >> quite a mission. any talk from the fbi on how they tracked this guy down? >> reporter: apparently he came here in january with this plan to commit some kind of terrorist act. he went out, you know, trying to connect with al-qaeda agents and as it's usually the case, lucky for us, the al-qaeda agent that he thought he was hooking up with was an under cover fbi agent. they went through this long period of planning, put together a 20-pound bags of explosives and took this drive and it was all rendered safe. he took the action that put him in a position to be criminally charged. >> lucky and good policework.

earlier this year, the fbi arrested a virginia man after he was caught in a sting. he thought he was going to blow up the u.s. capital. his explosives were also ininersed. he is serving a 30 year prison sentence. child care division were on the scene of a bethesda daycare center today. this after four two-year-olds wandered away from the center monday afternoon unnoticed by the people taking care of them. as andrea mccarren reports, the search is on for the good samaritan who spotted those toddlers and brought them back to the nter. >> there was a man who brought him home. i would like to know who he is. i would like to say thank you for finding my baby. >> wendy is overwelmed with gratitude for the unanimous good samaritan who led her two- year-old son, sam, to safety. >> god only knows what would

have happened. it was 4:45, there was a storm rolling in. they were walking betweened parked cars. if he hasn't found them, i don't know what could have happened. >> remarkably, little sam was one of four two-year-olds, three boys and a girl, who walked a block away from the montgomery childcare association's lynnbrook center. the daycare hired a public relations firm to respond to our questions. a statement detailed the steps being taken to ensure this doesn't happen again. the two teachers involved have been fired. >> how could you do this? how could you lose four children? >> wendy still has questions. >> where is my written report telling me what happened? what actions were taken immediately? did you shut down the entire building and count every other child and every other classroom? >> another unanswered question, how long were they gone? andrea mccarren, 9news. >> lots of questions there.

stafford county school officials say they have never seen anything like this. sheriff deputies pulled over a county school bus last friday after getting a call about chaos on board. a spokesperson says unruly students refused to follow sheriff orders and one was tased. a 15-year-old male student is charged with assault on a law enforcement officer and a 15- year-old girl is charged with disorderly conduct. the school system says more disciplinary action with these kids could be coming. a big blow to the prosecution today when a judge threw out first-degree assault charges against two prince georges county police officers accused of beating a university of maryland student. matt jablow was in the courtroom when it happened. he joins us live from upper marlboro with more. i guess that was a stunner, matt. >> lesli, day three of the trial brought some major developments and dramatic moments. chief among them, the officer, one of the officers involved in the case was finally called to the stand. 2 1/2 years after the widely publicized incident at college

park. >> open your hands, that's what officer baker claims he was yelling as he was hitting university of maryland student, john mccana with his baton. it was march 3, 2010, in the riotous aftermath of the basketball team's win over duke. james harrison are accused of second-degree assault for repeatedly hitting mckenna, who was unarmed at the time, with their batons. on the witness stand today, baker said he continued hitting mckenna because mckenna refused to show the officers if he had any weapons in his hands, which it turned out, he did not. earlier, immediately after the prosecution rested, officers baker and harrison scored a major victory when he threw out the top charge in the case. first-degree assault, saying prosecutors had failed to meet the legal standard for the charge. >> officer baker finished his testimony just a few minutes

ago. the trial resumes tomorrow when officer harrison might very well take the stand as well. lesli. we'll see what happens, matt, thank you. it looks like the trial for george zimmerman will begin next june. the neighborhood watch volunteer is accused of shooting 17-year-old trayvon martin last february in florida. this morning a judge tentatively set a trial date of june 10, they noted that there are several pretrial motions to resolve. that date could change. zimmerman faces second-degree murder charges in the death of the unarmed teen. anita. controlling the meningitis crisis tops our health alert today. the latest reports for the centers for disease control show 233 people battling infections nationwide. 35 in virginia, 16 in maryland. 15 people have died during the outbreak. the cdc is the nerve center of the response and scrambling to tackle this public health threat. demarco morgan gives us a look at the emergency operation center. >> you may have seen notice

that the case count has gone up in recent days. we think this is mainly because we are doing a better job at finding the cases. >> for some, it's already too late. more than a dozen people have died as a result of the fungal meningitis outbreak and now, with the fda's latest warning to doctors about other medicines, the outbreak is not looking so well for those in affected areas. the warning comes after reports of new illnesses that may be tied to the same company. we spoke with the lead of the clinical investigation. and phil, the director of the division of the emergency operations office. >> up to 14,000 people may have been exposed to one of the three potentially contaminated medication. meningitis is an inflammation or infection of the lining of the brain. it's important to note that

information out there. >> are we going to see more cases as other drugs are investigated from the same compounding pharmacy in new england? >> the answer is yes. these mold infections -- you can present up to four to eight weeks after an injection. the majority of injections that we have been using are a medication called cenalog, the first batch that was infected with the smaller fungag. >> fungas. >> why is this one pharmacy oviding medication to so many people? >> that's exactly right. compounding pharmacist have yewsed a great niche in taking care of patients. here what happened, because of medication shortages, we as physicians have tremendous shortages because of either cost or too much litigation in the united states. so a lot of products aren't made. so because of this, compounding pharmacists, we can do this on your behalf. so where it was, one or two

after four days in the wilderness, two hikers are safe at home. our surae chinn caught up with jason in herndon just this afternoon. she joins us live and surae, they really did fear for their lives. >> they really did, but you know what? they are thankful they are home. these two hikers were gone for four days stranded and so you know, they only had enough food for two days. what they did, get this. they rationed their cliff bars and what they did was, they took only a quarter of their energy bar, took one quarter for each person per day. >> there's so much snow.

there was no trail to be seen. >> 32-year-old jason from richmond and neil from herndon set out in the back country of glaisher national park. they were half way up the mountain when something terrible went wrong. pecken slipped and fell. >> when he fell, i was okay after he stopped sliding down the hill. >> worse still, their map blew away, they were lost in whiteout conditions. >> couldn't tell whether we should be going down or up because the map would have pulled us up. >> safest thing was to hunker down. the experienced hikers used their instincts. >> we had an s.o.s. sign out of burnt logs on the hillside. >> they were stranded for four days, rationing energy bars, 50 rescuers scoured the area on the ground and in the air. >> once we knew that people were actually looking, we felt better, but it was discouraging to have them fly over your head and not see you. after we knew they were looking, it was just a matter

of how long can we wait it out? >> the hikers never thought they wouldn't make it out alive, at least not for very long. >> fleeting thoughts at the time. you don't think about that at all. >> but it was their families who feared the worst. >> we were laying there thinking about what are our wives thinking? what are our families thinking? we can't do anything to change, because there's no way to communicate with them. >> they are very strong minded and they also continue to say they had ready made meals that they haven't dug into and they could have lasted six to seven more days. as for climbing up more mountains, they said their wives probably won't be having any of that for quite some time. by the way, they lost 15-pounds in their four-day ordeal. back to you. >> wow, amazing that they are alive to tell the story. derek. a crash involving a metro bus put eight people in the hospital today. this is at vermont avenue in

northwest. investigators say a van slammed into the back of that bus and most of the victims, as you might imagine, suffered neck and back injuries. investigators are trying to figure out why that van hit the bus. after about a year of work and $6 million in spending, a brand-new and wider bridge officially opened over route 50 in arlington today. representatives of the virginia department of transportation joined with the arlington county officials for the bridge ribbon cutting. the entire concrete deck of the 100 foot span had been replaced. that bridge was widened by 27 people. fairfax county has a new plan to transform tyson's corner into a downtown hub. the county's board of supervisors approved a 40 year funding plan that sets up a new tax district to pay for roads. under the plan, real estate taxes would increase by about 8%. the project would generate about $250 million from landowners over the next 40 years in tyson's. today, the national park service announced how you can

new englanders still a bit in shock today after an earthquake just rocked them yesterday. it happened around a quarter past 7:00 last night. the epicenter of the 4.0 quake was actually in portland, maine, but states as far away as connecticut felt the tremors. the rare occurrence caught some

the day after the second presidential debate, people are still talking about the heat the exchanges between president obama and governor mitt romney.

if you watched, you couldn't miss it and most of those came over who was telling the truth and who was selling some spin. so joining me now is ray locker. he's codirector of the fact checker efforts. very busy night. let's start with mitt romney's claims about job creation. listen to this. >> we have not made the progress we need to make to put people back to work. that's why i have a five point plan that gets america 12 million new jobs in four years and rising take home pay. >> so from what we know of governor romney's plan, will he be able to create those jobs? >> anybody would be able to create those jobs. independent reports, says 12 million jobs will be created in the next four years. >> regardless? >> regardless of who is president. >> okay. >> so, there's a little bit of truth to it, but it may not be a romney thing. it's misleading. now to the issue that brought the most sparks. when they talked energy, it got really intense. the candidates in this exchange

are talking about claims of the federal government cutting leases on public land. listen to this. >> what we did was take away those leases and we are now rerenting them so we can make a profit. >> and production on public land is down. >> production is wn 14%. and production -- >> what you are saying is not true. >> it's absolutely true. look. there's no question, but people recognize that we have not produced more oil and gas on federal lands and federal waters. >> so, if you were able to listen to that, other than being captivated by their exchanges there, what was the truth? >> well, the 14% reduction in oil production on federal land was true at one time. also factored in the moratorium on offshore drilling after the deep water horizon disaster in 2010. so in a way, it's blaming the ceo of honda for having a bad year after the tsunami in japan. >> so, again, everything is

really nuancey. the consulate in benghazi. let's listen to this. >> i think it's interesting the president just said something, which on the day after the attack, he went to the rose garden and said that this was an act of terror. you said in the rose garden, the day after the attack, it was an act of terror. it was not a spontaneous demonstration. is that what you are saying? >> please proceed, governor. >> i want to make sure we get that for the record. it took the president 14 days before he called the attack in benghazi an act of terror. >> he did in fact, sir. let me call it an act of terror in the rose garden. he did call it an act of terror. it did as well take two weeks or so for the whole idea of there being a riot of this tape to come out. you correct about that. >> that was the one point

where you heard people clapping. so clearly that conversation ressic enated. you would think this would be an easy thing to fact check, but is it? >> it is sort of. i reread the transcript of his remarks on september 12 in the rose garden and he did say it was an act of terror. referred to acts of terror. in the context of his speech, he was obviously talking about what happened to am ambassador chris stevens and the three others. he didn't say this specific attack is in an act of terror. but it makes sense. >> you fact checkers had to be on your game this go around and president obama was criticized for the first debate as pretty much, he didn't show up. this time, he showed up, he was on fire. so was governor romney. but the question really is, did either of them cross the line between being disagreeable and just being flat out rude? >> well, it's a political debate. the stakes are very high. the partisans on both sides want their candidate to be

celebration of women's brassieres, but breast reconstruction awareness day. the reason for it, plastic surgeons say 70% of women in this country are never told about all of their post cancer reconstructive choices. in tonight's health alert, how some survivors are changing things by baring it all. >> it took four surgeries to get here. >> kim isn't shy about showing breast cancer patients her body. she had a mastectomy and reconstructive surgery at the same time. says she couldn't be happier with the results. >> it was very, very important to share that experience with other women. i didn't want them just to have to look at a photo. >> some women are never shown surgical results or told that there are newer, cutting edge techniques that can improve results tremendously. >> oftentimes we'll see patients in here that had the mastectomy and just were never told they could have the reconstruction at the same time or at all. >> at the national center for plastic surgery, women can see an ipad full of examples of

what different reconstructive techniques look like. dr. mark says they often work together with cancer surgeons from the start on how the breast will be reshaped after a tumor is removed. they call it oncoplasty. >> the old goal of breast reconstruction was have the patient look normal with a bra and clothing on. since that time with advancements in technology, particularly in reconstructive surgery, the new goal is to actually have your breast look better than when you have been diagnosed with breast cancer. >> women like kim say they are living proof, such outcomes are possible. and singer, song writer, jewel, is lending her voice in support of this campaign. she written a song with proceeds benefiting the breast reconstruction awareness fund. >> when i was writing the song, there were a lot of survivors that came to mind. i am amazed at how resilient women are. they find the courage to say, i'm going to fight on and i'm going to be better.

us find folks and they brought us binders full of women. >> sounds funny and a lot of people thought so. it had its own twitter account by the end of the night. ladies, did you think anything of the binders full of women? >> didn't bother me at all. i liked the fact he wanted to have women in his campaign. that was the important issue. i focused on that. >> i was watching the debate at u.s.a. today with the political team there. we got a laugh out of it. but again, nobody thought it was in any way trying to be disparabling to women. he didn't say it in the most eloquent way. what you see is on social media, the campaign is jumping on this and making it even bigger, like big bird. >> clearly, if governor romney had a chance to do it over, he would have chosen his words carefully. what he was intending to say, listen, we did all we could to get women in these key positions. debates are about moments. this was one of the signature moments in the debate. it's something everybody is talking about and we should

expect both sides to pounce on it, which they have. >> in the social media era, everything blows up much bigger. speaking of things blowing up, racist and sexist. homecoming rally at an upstate high school is being called, three white male students reenacted the domestic abuse accident between chris brown and rihanna. two students in black face. the photo of the event went viral, some folks are upset. other kids say wait a second, these kids were just having fun, what's the big deal? what do you say? >> the big deal is, there's a history in this country. let's start with struggling to find the humor in reenacting a domestic abuse incident. it's not funny, black face, these kids may not have known what it meant. it's worse that the adult cosigned. they approve this skit. they saw it. so let's school everybody on what black face is. it's not just theatrical makeup. these were charactertures of african americans make it look

like we enjoyed second class citizenship in this country. it proliferated racial images. it was not funny then. it is not funny now. >> that's why i don't like lesli. >> i'm sorry. >> let's go to anita. >> again, where is the humor in this and where are the adults saying go ahead and do this? you can imagine that kids may do some stupid things, some inappropriate things and in some cases, some racist things, where are the adults stepping in to say this is not funny on so many levels. >> is it the fact that it was domestic abuse? i watch saturday night live and they'll have a white actor put on makeup. what is wrong with that? >> wrong, wrong, wrong. this country has come too far for us to revert back to those days. it's just wrong. it is sexist, it's racist, and since when is violence against women funny? >> i think that's the main point. i just don't think it's funny.

know, i'm a six month survivor of breast cancer. all right. i thought about having reconstructive surgery. i didn't have to do that. i didn't have to have a mastectomy. i was blessed, god blessed me with some knockers, but i didn't have to have a mastectomy. but let me tell you something. if i was dating a man and he had a problem because i didn't have breasts or i didn't have a nipple or whatever because i have gone through breast cancer, i would kick him to a curb in a new york minute. he would be out of my life. >> he can see your value, then they are not valuable. >> a young woman who is single -- it has to be a tough thing. to have that conversation. >> that's a tough moment. and i saw the website where all these women, so courageous, put themselves out there to show the scars of this disease and i was blown away by what these ladies go through. we think you are cured, everything is over, you are
